GAZETTE NOTICE NO. 1643

WHEREAS Samuel Luka, is registered as a proprietor of all that piece of land known as CIS-Mara/Leshuta/356, situate in Nartok County, and whereas the decision made on the 24th December, 2024 pursuant to appeal to the Minister directed that the parcel be subdivided and into two (2) equal portions and be shared between (1) Soitalo Luka and (2) Kiriane Ole Luka, and whereas contrary the said decision Kiriane Ole Luka caused a title to be procured in the name of his son Samuel Luka for the entire parcel, and whereas sufficient evidence has been adduced to prove that the title deed held by the one Samuel Luka and issued on the 18th February, 2021 was irregularly and fraudulently issued, and whereas all efforts made to compel 6th February, 2026 THE KENYA GAZETTE Samuel Luka, to surrender the said title deed and all efforts to have the title surrendered for cancellation under section 14 (a), (b) and section 79 (2) of the L.R.A. and regulation thereof but declined to do so, and whereas notice is given that, I intend to dispense with production of the said title deed and proceed to reinstate the parcel back to (1) Soitalo Luka and (2) Kiriane Ole Luka, to be available for subdivision into two (2) equal portions and subsequent transfer in their names, and upon such reversion the title deed issued to Samuel Luka, on the 18th February, 2021 shall be deemed cancelled and of no legal effect, provided that no objection has been received within that period.
