GAZETTE NOTICE NO. 1641

WHEREAS Ultra Eureka Farm Limited, is registered as a proprietor of all that piece of land known as CIS-Mara/Maji Moto/121, situate in Nartok County, and whereas the rightful and Bonafide owner of the above parcel is Kimaru Twala as supported by the allocation list, and Maji Moto Group Ranch, and whereas one Senet Ole Riamit was registered as the first owner who then transferred the parcel to Ultra Eureka Farm Limited, and whereas Senet Ole Riamit at the time of registration was not the bonafide owner, and whereas the High Court in ELC No. 268 of 2017 at Narok Law Courts decreed that all registrations and title deeds that were irregularly issued to non members or members who acquired more than two parcels without due process other than one share, the said titles be revoked and land be reverted to the rightful owner, and whereas sufficient evidence has been adduced to prove that the first registration of senet Ole Ramit was irregularly and fraudulently procured, and whereas the subsequent transfer of the said parcel to ultra Eureka Farm Limited on 14th June 2015 was null and void abinitio, and whereas all efforts made to compel Ultra Eureka farm Limited to surrender the said title deed and all efforts to have the title surrendered for cancellation under section 14 (a), (b) and section 79 (2) of the L.R.A. and regulation thereof but declined to do so, and whereas notice is given that, I intend to dispense with production of the said title deed and proceed to reinstate the parcel back to Kimaru Twala, Pursuant to decree in ELC No. 268 of 2017, and upon such reversion the title deed issued to Ultra Eureka farm Limited on the 14th June, 2014 and entry made in favour of Senet ole Riamit on the record shall be deemed revoked and cancelled and of no legal effect, provided that no objection has been received within a period of thirty (30) days from the date of this notice.
