ESTABLISHMENT


PURSUANT to the powers conferred upon me by section 31 (d) of the County Governments Act, Revised 2020 and the resolutions of the County Executive Committee made on 5th July, 2024 interlia proving the form all establishment of the internal County Government Pending Bills Verification and Ineligible (Pending Bills) Resolution Committee. I herewith appoint the following officers as the committee members for a period of three (3) years. The Committee shall consist of— The CECM, Finance, Economic Planning and ICT (E-government) Services–Chairperson; The County Attorney; The CECM Infrastructure and Public Works; The Chief Finance Officer (CFO); 24th January, 2025 THE KENYA GAZETTE Principal Superintendent, QS Jackson Kaki; The Director, Procurement, Mr. Geoffrey Ochieng Nyatuga; County Structural Engineer, Wycliff Bokea; The Deputy Director Audit, Nicodemus Kakori – Secretary; The Deputy Director Roads, Davis Nyangoto (Eng.); Graduate Water Engineer, Mary Aseta. Secretariat to the Committee Violet Ombasa (CPA); Lydiah Moraa (Secretarial Service); Violet Moke Kimai (Records). The Chairman and other members of the committee shall, prior to embarking on their duties, subscribe to the declaration prescribed to a no conflict-of-interest declaration and oath of secrets. The Terms of Reference of the Committee shall be to— (a) scrutinize, analyze and verify all existing stock of County Government of Kisii pending bills and ineligible (Pending Bills), with a view to making appropriate recommendations to the County Treasury for payment or otherwise; (b) adopt and apply the procedure and criteria for dealing with existing County Government pending bills developed by the Treasury; (c) identify cases where there may have been corrupt, fraudulent and false claims against the County Government and make appropriate recommendation to the relevant Government/State departments; (d) prepare a payment priority list of all cleared payments taking into account the need for equitable treatment of the creditors and of the cash-flow realities of the County Government; (e) develop a system to ensure that future escalation of pending bills within the County Government is avoided; and (f) perform any other function incidental to the foregoing or as may be provided by the County Treasury. In the performance of its functions, the Committee— (a) shall hold such number of meetings at such places and such times as the committee shall consider necessary for the proper discharge of its mandate; (b) may consult with the Governor on any matter within its (c) shall have access to reports of any previous investigations relevant to its mandate; (d) shall, as it considers appropriate, carry out or cause to be carried out such studies or research as may inform the committee on its mandate; (e) may submit monthly progress reports to the Governor; and (f) Subject to the foregoing, they shall have all the independence necessary for carrying out its function or expedient for the proper execution of its mandate, including the power to regulate its own procedure without being the subject of control by any other authority. The Committee shall— (a) within (1) one month, after scrutiny and analysis of the County Government’s stock of pending bills, (or such longer period that the Governor may authorize) submit to the Governor a report recommending to the Treasury settlement or otherwise of the pending bills; (b) within (2) two months submit to the Governor a final report detailing a system geared towards ensuring that future escalation of pending bills within the County Government is avoided and on the streamlining of the procurement processes within the County Government; (c) submit as appropriate, interim reports to the Governor as the committee may find fit and necessary or as the need arises; and (d) in consultation with the Governor, have the power to co-opt or to appoint committees as it deems fit only for specialized aspects of its terms of reference. The Secretariat of the Committee— The Secretariat of the Committee shall be based at the County Headquarters and shall be responsible to the committee for— (a) providing appropriate background briefing to the Committee; (b) preparing the Committee’s reports and disseminating any information deemed relevant to the Committee; and (c) undertaking research and liaising with the relevant National and County Government Departments and any other institution in order to gather relevant information necessary for informing the Committee.
