APPOINTMENT


PURSUANT to Article 43 of the Constitution of Kenya 2010, sections 68, 77 (1), (2), (3), 78, 97 (1), (2) and 100 of the Water Act, 2016, sections 948–953 of the Companies Act, 2015, WASREB Guidelines 2024, and the resolutions of the joint meeting between the County Governments of Bomet and Kericho, BOMWASCO, KEWASCO, LVSWWDA and facilitated by WASREB on 22nd November 2024, the Governors of Bomet and Kericho and the CEO, LVSWWDA appoint the following office holders to serve as members of the Itare–Litein Bulk Water Supply Taskforce: BOMET COUNTY GOVERNMENT (a) CECM for Water, Sanitation, Natural Resources, Environment and Climate Change (b) Chief Officer for Water, Sanitation, Natural Resources, Environment and Climate Change KERICHO COUNTY GOVERNMENT (a) CECM for Water, Energy, Natural Resources and Forests (b) Chief Officer for Water, Energy, Natural Resources and Forests BOMWASCO (a) Chairperson, Bomet Water and Sanitation Company (b) MD, Bomet Water and Sanitation Company KEWASCO (a) Chairman Kericho Water and Sanitation Company (b) MD, Kericho Water and Sanitation Company LVSWWDA (a) Senior Manager, Water Works and Services (b) Manager Legal Services and Corporate Secretary (c) Manager Water Services and County Liaison Additionally, there shall be a secretariate comprised of three officers, one each from LVSWWDA, BOMWASCO and KEWASCO to facilitate the process. TERMS OF REFERENCE FOR THE TASKFORCE: Objectives • Facilitate a seamless and conflict-free transition of the Itare-Litein Water Supply Scheme management from BOMWASCO to LVSWWDA. • Address and resolve technical, operational, financial, and institutional issues related to the transition. • Ensure continuity of water supply during and after the transition process. Specific Responsibilities of the Taskforce The Taskforce shall undertake the following responsibilities: 1. Conduct a detailed technical and operational audit of the Itare-Litein Water Supply Scheme, including infrastructure, assets, and current operational practices. 2. Facilitate the handover process, including the transfer of operational, financial, and administrative responsibilities. 3. Develop a Bulk Water Supply Agreement (BWSA) outlining roles, responsibilities, terms, conditions and cost-sharing arrangements between LVSWWDA, BOMWASO, KEWASCO, Bomet County and Kericho County. 4. Propose a mechanism for resolving transboundary issues and fostering collaboration between the two counties. 5. Prepare a Transition Plan that includes Assets, Liabilities and Human resource transition (if applicable) and Facilitate the handover process, including the transfer of operational, financial, and administrative responsibilities 6. Prepare and implement effective Stakeholder engagement plan and communication strategy 7. Identify and mitigate risks associated with the transition to ensure uninterrupted water supply. 8. Submit a final report with recommendations to the respective counties and LVSWWDA.
