GAZETTE NOTICE NO. 16964

WHEREAS Full Gospel Churches of Kenya, is registered as the owners of all that parcel of land known as Kwale/Shimoni/780, being a subdivision of Kwale/Shimoni/187, on 14th September, 2017 and whereas Francis Kitonyo is registered as owner of all that parcel of land known as Kwale/Shimoni/781, being a subdivision of Kwale/Shimoni/187, on 4th September, 2017 and whereas Monica Kateve Muthoka is registered as the owner of all that parcel land known as Kwale/Shimoni/255 and whereas the said properties were previously registered in the names of Francis Wambua Kimanga who later did change of name to Wambua Kimanga Nguna and whereas the said Wambua Kimanga Nguna died on 24th October, 2009 and his death having been registered under death certificate No. 017100725 on 28th May, 2010 and whereas the transactions on the property having been carried out on the diverse dates after the death of the registered proprietor without carrying out succession process as stipulated under the laws of Succession and having been unable to obtain any court proceedings governing the laws of Succession and having been satisfied that the transactions for the property known as Kwale/ Shimoni/187, later subdivided to Kwale/Shimoni/780 and 781 respectfully and Kwale/Shimoni/255, were done illegally, unprocedurally, irregularly and unlawfully. Notice is issued that after the lapse of 30 days from the date of this Notice, Tittle Deed and registration of Properties known as Kwale/Shimoni Adj/780 and 781, And Kwale/Shimoni Adj/255 and having issued summons to Francis Kitonyo as registered owner of all that parcel of land known as Kwale/Shimoni 781, Full Gospel Churches of Kenya as registered owner of Kwale/Shimoni/780 and Monica Kateve Muthoka as the registered owner of Kwale/Shimoni/255 and the said individuals having failed to appear and surrender/return the said Tittle Deed for cancellation. Notice is issued from the date of this notice. The said Tittle Deeds stands cancelled and of no effect hence Null void and the registrar will proceed to rectify the register as stipulated under section 79 of Land Registration Act 2012 revised and reinstate the names of Wambua Kimanga Nguna (deceased) for the process of Succession.
