APPOINTMENT


PURSUANT to the provisions of the Constitution of Kenya, and section 35 of the Judicial Service Act, Cap. 8A, the Chief Justice of the Republic of Kenya and the Chairperson of the National Council on the Administration of Justice (NCAJ) appoints the following members to the NCAJ Standing Committee on Criminal Justice Reforms, for a period of three (3) years. The Committee shall— 8218 8218 (a) identify and formulate policy, legal and institutional recommendations necessary for better functioning of the criminal justice system in Kenya; (b) establish and design mechanisms to ensure that Kenya’s criminal justice system operates in a manner consistent and compliant with the provisions of the Constitution; (c) identify legal, institutional, administrative, and financial barriers that impede the efficient functioning of the criminal justice system and recommend interventions; (d) support inter-agency collaboration and cooperation to make the criminal justice system effective in serving the Kenyan public; (e) review laws and policies that criminalize petty offences and make recommendations on their decriminalization and reclassification; (f) formulate and review laws that would render efficient administration of criminal justice in compliance with the provisions of the Constitution; (g) oversee the implementation of the recommendations of various strategic publications by NCAJ on Criminal Justice Sector reforms; (h) oversee the undertaking of studies to deepen, expand, and advise the efficient administration of criminal justice; and (i) sensitize stakeholders and the public on the criminal justice reforms. 2. In the discharge of its mandate, the Committee may, on temporary basis, identify and invite relevant technical expert(s) on a specific issue or agenda. 3.
