SETTLEMENT

IT IS notified for general information and pursuant to section 39 of the Competition Act, 2010, ("the Act"), that in exercise of the powers conferred by section 70A, the Authority initiated investigations against Del Monte Kenya Limited ("the Company"), the Competition Authority of Kenya ("the Authority") has entered into a settlement agreement with the company 'pursuant to section 38 after the company was found to have contravened sections 55 (a) (i) of the Act. Under the settlement agreement — (a) the Authority has imposed a financial penalty to the tune of Kenya Shillings seven hundred and seventy six thousand, and twenty-five (KSh. 776,025.00) on the company; and (b) the company gave a written undertaking vide the settlement Agreement stating that they wish to resolve the matter amicably by invoking the provisions of the Act.
