THE STATUTORY INSTRUMENTS ACT
ESTABLISHMENT
PURSUANT to section 70 of the Computer Misuse and
Cybercrimes Act, 2018 and the Statutory Instruments Act, 2013, the
Cabinet Secretary for Interior and National Administration notifies the general public that a Regulatory Impact Statement on the proposed
Computer Misuse and Cybercrimes (Critical Information Infrastructure and Cybercrime Management) (Draft) Regulations, 2023, has been prepared to assess the impact of the Regulations on the community and businesses.
The main objective of the proposed regulations is to facilitate effective management of critical information infrastructures and cybercrime management. Specifically, the draft regulations seek to—
(a) provide a framework to monitor, detect and respond to cybersecurity threats in the cyberspace belonging to Kenya;
(b) provide for frameworks for establishment and management of
Cybersecurity Operations Centres;
(c) provide for protection, preservation and management of critical information infrastructure;
(d) provide for audit and inspection of national critical information infrastructure;
(e) provide for recovery plans in the event of a disaster, breach or loss of national critical information infrastructure or any part of it;
(f) provide a framework for capacity building on prevention, detection and mitigation of computer and cybercrimes and matters connected thereto as envisaged under section;
(g) promote co-ordination, collaboration, co-operation and shared responsibility amongst stakeholders in the cybersecurity sector including critical infrastructure protection; and
(h) provide for mechanisms for cybercrime management among others.
This is therefore to request all persons likely to be affected by the proposed Regulations to submit written memorandum to reach the undersigned within fourteen (14) days from the date of publication of this notice to the email address regulations@nc4.go.ke.
