IT IS notified for general information of the public that pursuant to Article 184 of the Constitution of Kenya, 2010, as read with sections 20 and 21 of the Urban Areas and Cities Act, 2011 and section 2.3 of the Rumuruti Municipality Charter, 2018, that the County Executive Committee of the County Government of Laikipia has transferred the following initial functions currently performed by respective County Departments to the Rumuruti Municipality, with effect from the 1st November, 2023, as set out in the Schedule below. All the resources currently performing the said functions including staff, budget and assets are transferred accordingly. The transfer of functions shall be exercised in as far as it is consistent to the Constitution, National Laws, County Laws and all relevant government policies. S/No. Transfer of Functions 1. Promotion, regulation, and provision of refuse collection and solid waste management services including: (a) Solid waste management; (b) Dumpsite management; 1st December, 2023 THE KENYA GAZETTE S/No. Transfer of Functions (c) Maintain general cleanliness of the municipality; (d) Enforcement of laws related to waste management. 2. Water and Sanitation including: (a) Provision of facilities and services for safe disposal of liquid waste in liaison with the Departments of Infrastructure, Lands, Public Works and Urban Development; Water, Environment and Natural Resources; and, the Nyahururu Water and Sanitation Company. (b) Waste water management in liaison with the Department Water, Environment and Natural Resources and Nyahururu Water and Sanitation Company. (c) Supervision, management and maintenance of public county toilet construction. (d) Protection of water supplies including but not limited to minimizing pollution along water bodies; securing riparian land; initiating relevant complaints and revocation of ownership documents where riparian land has been grabbed; securing riparian rights and undertaking any other relevant duties. (e) Protection of environment in liaison with the Department Water, Environment and Natural Resources and other relevant government institutions. (f) Promotion of recycling and composting. (g) Waste handling including transportation and disposal of waste. (h) Control of air pollution, noise pollution and other public nuisances. 3. Construction and maintenance of Municipal administrative offices and yards; • Construction and maintenance of administrative offices; and • Ensure compliance for contracted building services. 4. With the consultation and advise of the Departments of Infrastructure, Lands, Public Works and Urban Development, undertake design, construction and maintenance of Urban Roads and Associated Infrastructure including; (a) Construction of Urban Roads within the Municipality including: • Mapping of road reserves; • Opening of roads; • Survey works; • Installation of culverts; • Installation gabions, cut off drains; and • Periodic and routine maintenance of roads. (b) Maintenance of Urban Roads within the Municipality including: • Re-carpeting of roads; and • Cleaning of drains. (c) Improving of Urban and Rural Roads within the Municipality: Upgrading the roads. 5. Construction and Maintenance of Storm water drains and flood control infrastructure within the municipality including; • Design of storm water drainage structures; • Construction of storm water drains and scour checks; S/No. Transfer of Functions • Installation of Culverts; • Opening/unblocking of the drains; and Installations and construction of gulley pots. 6. Construction and maintenance of walkways and other non- motorized transport infrastructure including; • Demarcation of walkways and non-motorized transport areas; • Design and construction of pavements/walkways; • Construction and maintenance of public transport stages and stopovers; bus stands and taxi stands; and traffic management. • Control and management of kiosks including controlling development and allocation. • Signage; and • Enforce proper use of walk-ways. 7. Design, construction and maintenance of street lighting and floodlights; (a) Design and Installation of Street lighting including • Identification of sites; • Design and preparation of BOQs; • Installation of streetlights; • Servicing and maintenance schedules; • Contracting; • Construction; • Supervision; • Completion; and • Commissioning. (b) Maintenance of street lights including: • Routine checks during maintenance; • Management of Flood lights; and • Payment of bills – logistics. 8. Construction and maintenance of recreational parks and green spaces: (a) Design and Construction including; • Landscaping and beautification work within the municipality; • Management of Recreational Parks and green spaces; and • Enforcement of Laws related to Green spaces and parks. (b) Maintenance of recreational parks and green spaces including; • Landscaping and beautification work within the municipality. Enforcement of Laws related to Green spaces and Recreational parks. 9. Development and enforcement of municipal plans and development controls as may be delegated by and with the supervision of the County Executive Committee Member for Infrastructure, Lands, Public Works and Urban Development including: (a) Identification, Mapping and Zoning of Public Lands; (b) Survey and Ownership; (c) Documentation and Road registration. 10. Outdoor advertising including: 5436 5436 S/No. Transfer of Functions • Wall branding; • Sign boards; • Bill boards; • Banners; • Leaflets; • Posters; • Tent pitching; • Vehicle branding; • Road shows; • Sandwich men (entertainers); • Umbrella branding; • Neon signs; • Kiosk branding etc. 11. Promotion, regulation, and provision of animal control and welfare including: (a) All aspects of animal well-being, including development of regulations, proper housing, management, nutrition, disease prevention and treatment, responsible care, humane handling, and, when necessary, humane euthanasia; (b) Disposal of animal including removal of carcasses in public places; (c) Licensing regime for all pets including but not limited to dogs; (d) Issuance of certificates; (e) Picking of stray dogs and other pets; and (f) Enforcement of animal Act. 12. Promotion of environmentally friendly, sustainable and economical agricultural activities including urban agriculture, school kitchen gardens, tree planting e.t.c 13. Promotion, regulation, and provision of municipal sports and cultural activities: (a) Sports development and management including; and (b) Management of county social halls and stadiums. 14. Construction and maintenance of Municipal Markets and Abattoirs including: (a) Live animal markets; (b) Fresh Produce markets; (c) Open air markets. 15. Construction and maintenance of fire stations; provision of fire-fighting services; emergency preparedness; and, disaster management. 16. (a) Control and management of public entertainment centers as may be delegated by the County Executive Committee Member for Administration, Co-ordination, ICT and Public Service; and (b) Pornography, drug and substance abuse control. 17. Management of: (a) public cemeteries, funeral parlors and crematoria; and (b) exercising oversight over private cemeteries, funeral parlors and crematoria. 18. Recruitment of staff and exercising any other delegated duties as may be delegated to it by the Laikipia County Public Service Board as per the provisions of section 86 of the County Governments Act. S/No. Transfer of Functions 19. Exercise any other functions that may be delegated to them by the County Executive Committee from time to time. Without prejudice to any other provisions of the law, the Rumuruti Municipality Board shall, through the County Executive Committee Member for Infrastructure, Lands, Public Works and Urban Development, furnish my office with quarterly reports on the implementation status of these functions.
