THE ENVIRONMENTAL MANAGEMENT AND CO—ORDINATION ACT

(No. 8 of 1999)

Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project The proponent, Best Base Investment Limited, is proposing to put up 184 No. housing units in a gated community setup on a beach plot of land measuring 2.229 hactares comprising; 160No. car park spaces, swimming pools, infinity pool, basketball ground, football pitch and rock climbing on plot L.R No. MN/III/3237 at Msumarini beach, Kikambala, Kilifi County. The following are the anticipated impacts and proposed mitigation measures: Impacts Proposed Mitigation Measures Blockage of • All drainages to have covers. drainage • Labeled and colour coded waste bins to be provided at strategic points of the entire development. • Hazardous waste bins that are leak proof to be set in the lab section of the project. • Prompt collection and disposal of generated solid waste by NEMA certified company. • No disposal of any solid or liquid waste within the riparian vegetation of the wider beach environment. • Waste receptacles to be provided at the proposed project site for dropping of waste. • Vehicles that will be used to collect solid waste from the proposed construction site for disposal must be licensed by NEMA. • Organize regular beach cleaning activities. • NEMA registered waste collection and Disposal Company to be hired to collect and dispose all waste generated from the proposed construction site and dispose the collected waste to NEMA licensed disposal sites. • There should be no cutting of any vegetation within the riparian zone. • Observe 60 meter riparian reserve from the high watermark within which no development of any kind should be done. Impacts Proposed Mitigation Measures Physical removal • No removal of any beach sandy for of beach sand construction work or any other use. from the beach • No cutting or removal of any riparian vegetation or any dead or dry vegetation matter from the riparian zone as all these have a role in protecting and conserving the beach. • No physical solid structures such as walls should be constructed within the riparian zone of the beach. Attraction of • A cold room for handling rapidly decomposing disease causing waste such as food left offers to be provided for vectors in the restaurant kitchen. • All waste bins to be emptied daily. • All waste bins to have lids on. • Regular emptying of grease traps. • Regular fumigation of waste storage locations with environmentally neutral chemicals. Littering and • Regular beach cleanup. scattering • Posting of signs to encourage responsible waste disposal. • Waste Collection Company to ensure there is no littering and scattering of waste during collection and transportation. Awful smell • All waste bins to have lids on always. • Temporally cold waste handling facility for rapidly composing waste to be provided. • Prompt repair and maintenance of bursts and leakages. • Effective aeration to be done. • Microbial activity to be enhanced to fasten digestion and breakdown of sewage contents. Hazardous wastes • Oil rugs, filters, batteries and burnt out mercury lamps to be segregated and handled as hazardous waste. • Appropriate waste contractor with experience in handling hazardous waste to be contracted. Noise Nuisance • Noisy machines to be fitted with silencers. and Pollution • Undertake a noise survey for the work place to determine appropriate noise mitigation strategies. • Limit number of employees and duration of exposure to noise above statutory noise limit. • Provide employees exposed to above statutory noise limits with ear protectors. • Employees to observe silence on site. • Construction work to be limited to day time, machine activity to be limited to construction site, noisy machines to be fitted with silencers. Contamination of • Effective treatment of the sewage to be done ground water before discharge to the environment. resources • Ensure Biological Oxygen Demand (BOD) of the sewage is 30mg/1 or less before discharge to environment. —Ensure Carbon Oxygen Demand of the sewage is 50mg/1. or less before discharge to environment. Disposing of construction waste within the riparian vegetation Cutting and removal of riparian vegetation from the riparian zone 25th October, 2019 THE KENYA GAZETTE 4219 Impacts Proposed Mitigation Measures Dust, Nuisance • Sprinkle water on dusty ground twice a day and Pollution during dry spell. • Provide employees with dust masks. • Plant trees on open ground. • Encourage vegetation growth on open areas; • Provide personal protective (PP4) clothing to each employee. • Secure loading and offloading zone with dust screens. • All excavated top soil to be stockpiled for landscaping work. • Excavated rocks, cleared vegetation and construction debris to be dumped at officially designated dump site. Occupational • Fence off and seal site from public access. hazards • Employees working at height to be provided with appropriate working gear. • Use appropriate elevators and other lifting machinery in conveying building material to high levels. • Building to be constructed strictly with specifications of structural Engineer's requirements. • Constant checking of adherence to required specification and verifications by Government Engineers. • Adherence to site specification. • Adherence to time and material specifications.
