PURSUANT to the provisions of Article 187 of the Constitution of Kenya as read together with section 26 (1) and (3) (b) of the Intergovernmental Relations Act, 2012, and following the legal opinion dated the 25th September, 2019, by the Solicitor-General approving the retrospective signing of an agreement between Kenya National Highways Authority (KeNHA), on behalf of the National Government, and the County Government of Bungoma for the transfer and or delegation of power for financing and contract for the dualling of the Kanduyi—Sangalo Junction section of (C33) Road; I, Wycliffe Wafula Wangamati, Governor, Bungoma County, wish to notify the public as follows; 1. That KeNHA and Bungoma County Government signed an Agreement dated the 1st October, 2019, for the transfer and or delegation of power for the dualling of the Kanduyi—Sangalo Junction section of (C33) Road; 2. That the effective date of the agreement dated the 1st October, 2019, is 2nd October, 2018, as per recitals of the agreement being the date of project inception meeting between KeNHA Officials and Bungoma County Government Officials. 3. Any interested party may obtain a copy the signed agreement dated the 1st October, 2019 at the County Secretary's office at the County Government Headquarters in Bungoma.
