IN EXERCISE of the powers conferred by section 83 (1) of the Proceeds of Crime and Anti-Money Laundering Act, 2009, the Agency Director gives notice to Peter Oluwafemi Olaiwon that the High Court has issued preservation orders in Nairobi High Court Miscellaneous Application No. E34 of 2021 as specified in the Schedule hereto: REPUBLIC OF KENYA IN THE HIGH COURT OF KENYA AT NAIROBI ACEC MISC. NO. E 34 OF 2021 In the Matter of: An Application for Orders under Sections 81 and 82 of The Proceeds of Crime And Anti-Money Laundering Act (POCAMLA) as read together with Order 51 of The Civil Procedure Rules. -AND- In the Matter of: USD 28,000 (Twenty-Eight Thousand US Dollars) -BETWEEN- Assets Recovery Agency Applicant -VERSUS- Peter Oluwafemi Olaiwon Respondent ORDER IN CHAMBERS before Hon. Lady Justice E. N. Maina on 11th November, 2021, upon reading the application dated the 11th November, 2021, presented to this court on the same date by counsel for the Applicant under sections 81 and 82 of the Proceeds of Crime and Anti-Money Laundering Act and Order 51 of the Civil Procedure Rules and upon reading the supporting affidavit sworn by Fredrick Musyoka together with the annextures thereto: IT IS HEREBY ORDERED: - 1. THAT the application be and is hereby certified urgent. 2. THAT preservation and seizure orders be and are hereby issued of the following US Dollars found in the possession of the Respondent; (i) USD 28,000 (Twenty-Eight Thousand US Dollars) 3. THAT an order be and is hereby issued that the funds specified under order 2 above be deposited in the Assets Recovery Agency preservation Account Number 1240221339 held at Kenya Commercial Bank Limited, KICC Branch. 4.
