PURSUANT to section 53 (9) of the Advocates Act and Rule 12 (1) of the Advocates (Complaints Commission) Rules, 1991, it is notified for general information that from the 1st October, 2020 to 31st December, 2020, the Commission received a total of two hundred and seventeen (217) new complaints and submitted them for enquiry under the Preliminary Enquiry initiative. NOS. MN/VI/4689 AND MN/VI/2428, PORT REITZ AREA, MOMBASA COUNTY INVITATION OF PUBLIC COMMENTS PURSUANT to regulation 21 of the Environmental Management and Co--ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Mahadi Energy Limited, proposes to construct and operate an LPG terminal depot with a total storage capacity of 15000MT of LPG heid in 9 mounded tanks of 1650MT each. It will consist of LPG truck loading bays, office block with 2 floors, generator room, fire water tank, LPG evaporation wall (600m high), associated facilities and amenities on Plots L.R. Nos. MNNI/4689 and MN/VI/2428, Port Reitz Area, Mombasa County. The following are the anticipated impacts and proposed mitigation measures: Possible Impacts Mitigation Measures Installation of LPG • LPG tanks should be installed in accordance tanks and pipeline with NFPA 58 and EEMUA publication 190 • The pipe works to comply with the KS 1938- 3: 2012 and BSEN 1600 and ISO 3183 standards. • Valves and other fittings to comply with the relevant API and ISO standards. • The installation of the LPG tanks will be preceded by a soil investigation to determine the expected overall and differential settlement as required by KS 1938-3:2012. • Consultations with the Fire Department of Mombasa County Government regarding the placing of the LPG tanks. Occupational safety • Register the facility as a workplace with and health risks DOSHS. • Erecting a barrier/reinforced concrete slabs around the buried LPG tanks. • Test and inspect all LPG tanks and vaporizers. • Display of precautionary signage at appropriate locations. • Provide adequate and appropriate PPE and enforce on their use. • Sensitize employees on work procedures. • Provision of well-stocked first aid kits within the facility. • Train workers on occupational safety and health and first aid. • Conduct occupational health and safety audits. 8th January, 2021 THE KENYA GAZETTE 29 Mitigation Measures in respect to fire-fighting/fire protection facilities. • All persons doing installation of LPG tanks and appliances should be registered with the Energy and Petroleum Regulatory Authority. • Installation of LPG tanks to comply with minimum safety distance of at least 15m as per KS 1938-3: 2012 as follows. Possible Impacts Mitigation Measures the facility. • Install/construct a bio-digester to manage effluent. • Apply for and obtain an Effluent Discharge License (EDL) from NEMA. • Monitor the quality of effluent discharged from the bio digester. Possible Impacts preparedness Air pollution • Installation of LPG detectors/sensors to detect any gas leaks. • Don't permit loose, or piled combustible material, weeds and long dry grass should not be permitted within 3m of any LPG tank. • Installation of an appropriately designed fire alarm and an electrical, hydraulic or pneumatic emergency shutdown system (ESD). • Provide adequate water supply for fire protection. • Slope the surface below the LPG tanks (minimum 2%). • Provide sufficient, acceptable, portable firefighting equipment on site. • Access to and around the installation should be provided for firefighting and should be kept free at all times. • Notices setting out the emergency procedures should be prominently displayed near the LPG storage area. • LPG tanks should be electrically earthed. • Conduct fire irainings to workers and local community. • Conduct fire drills and incorporate the local community in the exercise. • Undertake fire safety audits and recommendations implemented. • Develop a plan of action to guide transfer of LPG and ensure strict adherence to the operational procedures. • Deploy only qualified personnel to undertake the tasks. • Tests on the LPG tank should be scheduled regularly and actions prescribed to safeguard tank integrity. • Install gas detectors to detect gas release. • Provide and enforce the use of appropriate PPE. • Monitor fugitive emissions Increased energy • Use renewable energy such as solar to power demand the lighting system. • Install compact fluorescent lights in high use areas within the facility. • Keep records of power consumption. • Create awareness on energy conservation. • Conduct energy audits and implement the recommended actions. Waste generation • Provide litter bins with a capacity for waste segregation. • Procure the services on a NEMA licensed waste contractor to dispose off wastes from • Comply with the Waste Management Regulations, 2006. • Comply with the Water Quality Regulations, 2006.
